License Agreement

This End User License Agreement (EULA) outlines the terms and conditions for using our font software. By purchasing and using our fonts, you agree to comply with these terms. Please read this agreement carefully and keep a copy for your records. If you have any questions or need further clarification.

Ownership

By buying the font software on the haendehoch typografik website you have confirmed to comply with the following end-user license agreement. The font software you thus received is and remains the intellectual property of haendehoch typografik. If conditions are unclear, please let us know at kontakt@haendehoch.nl.

Use

This license is perpetual and provides the use of the font software to produce human-readable text in non-embedded, rasterised files like for example JPEG, JIF, GIF, TIFF or PNG, or non-font outlined files like PDF or EPS formats. Thus haendehoch font files should always be outlined vectors when providing created artworks or texts to unlicensed parties such as your clients. The font software also can never be included in the CSS of websites.

Modification

Decompiling, disassembling or modifying the font software in any possible manner is strictly prohibited. If there is a wish for adjusting certain individual glyphs, adding alternates, weights, styles or moving characters to different Unicode positions, please contact us. Modification is only possible under haendehoch typografik’s conditions and final permission.

Distribution

Sub-licensing, distributing, transmitting, leasing, loaning or selling of the font software in whole or in part to any third party is strictly prohibited. Also renaming the purchased font software and selling or otherwise distributing it, is prosecutable and legal measures against intellectual property theft will be undertaken. If you violate any of the provisions of this license, you will subject to pay the actual costs of investigating and addressing the violation, enforcing the license and/or reaching a settlement. This will include investigators’ and attorneys’ fees.

Warranty

Haendehoch typografik’s font software is provided without warranty (either express or implied) of fitness for a particular purpose. There is no guaranty that the font software will operate error-free or uninterrupted. If the font software is damaged in transit at the time of delivery to you or otherwise contains errors that can be reproduced by review of the font software, replacement font software will be provided for those specific purchases when possible.

Liability

In no event haendehoch typografik will be liable to you or any other entity for any indirect, incidental, consequential or punitive damages, including loss of profit or goodwill. Haendehoch typografik’s total liability for damages, if any, will be limited to the total fees paid to haendehoch typografik for the concerning font software. Haendehoch typografik cannot provide refunds, but we are open to feedback and will always strive for a mutual satisfactory solution of the issues.

Upgrades

Upgrades and updates can be the subject of a new license overruling the previous one and thus these new terms may result in different fees.

Termination

Haendehoch typografik reserves the right to unilaterally amend the terms of the license insofar as any provisions herein are rendered obsolete or incomplete by unforeseeable future technological developments.

Marketing

The licensee hereby agrees to do its best to credit and identify the font names and haendehoch typografik in the colophon or the design credits of the concerning project. From the moment the licensee makes the use of our fonts public, haendehoch typografik is entitled to use the images, videos, names and credits associated with the use of the font for haendehoch typografik’s own marketing and communication purposes. You agree that we may use your material containing your company’s name, logo and other trademarks in combination with the use of our fonts, to post these to social media, websites, in books, lectures, case studies, portfolios, and may allow third-parties to do likewise. If you as a licensee do not wish to allow us to do so, then please let us know by contacting us via e-mail within fourteen days of purchase and then we will provide an adjusted license.
